Paying a booking amount is often the first moment a property search turns into a legal commitment. If plans change, the question becomes: **can you cancel the flat booking and recover the money?** There is no universal answer that every withdrawal earns a full refund. It matters why the purchase is being cancelled, what was signed and whether the promoter failed to meet a legal or contractual obligation.
Read the documents before paying even a small token
Ask for the booking application, allotment terms, proposed agreement for sale and complete cost sheet. Identify whether the payment is called a token, expression-of-interest deposit, booking fee or advance. The label alone does not decide refund rights; the written conditions and governing law matter. Locate clauses on cancellation charges, financing failure, deadlines, changes in area or specifications and the seller's right to re-allot the unit. Do not sign an incomplete form or rely only on a sales representative's messaging.
Understand the RERA advance-payment safeguard
Section 13 of the Real Estate (Regulation and Development) Act, 2016 restricts a promoter in a covered transaction from accepting more than **10% of the apartment cost** as advance or application fee without first entering into a written agreement for sale. This safeguard is not a general permission to demand back any payment whenever a buyer changes their mind. The agreement must set out obligations such as development details, instalments and possession arrangements. Check WBRERA disclosures for the relevant project and phase where registration applies.
Distinguish voluntary withdrawal from promoter default
If the buyer voluntarily changes location, employment plans or financing arrangements, the contractual cancellation clause may be decisive, subject to consumer protection and other applicable law. Different considerations apply when the developer does not complete the project as promised, provides misleading material information or otherwise breaches applicable obligations. Do not promise yourself a fixed refund percentage simply because another buyer received one. A lawyer should examine the signed paperwork, correspondence and payment trail.
Make cancellation formal and traceable
Send a dated notice to the contractual address or official email listed in your documents. Identify the project, tower, unit, application number, amount paid and exact remedy sought. Give reasons factually and attach evidence rather than making allegations you cannot prove. Ask for a written account of any deduction and the expected payment process. Keep copies of the submitted request and delivery acknowledgements. Do not rely on a telephone assurance that 'accounts will process it'.
