Registering a sale deed is a major step in buying a flat, but it may not complete the administrative update in the property's municipal records. **Mutation** is the process by which the competent authority records a change for purposes such as assessment, taxation or revenue administration. Buyers should understand how to apply—and why mutation is not the same as legal ownership.
Mutation and title are different
A registered sale deed, chain of title and other legal instruments form part of the evidence of ownership. A municipal mutation entry helps update the authority's assessment records. It should not be treated as a certificate that the property has a flawless title or no mortgage, court case or boundary dispute. A separate legal title search is still important.
Similarly, a tax receipt in the seller's name does not prove that the seller can transfer a flat free of encumbrances. Buyers should review the complete legal file before registration, not only the mutation certificate.
For properties under Kolkata Municipal Corporation
KMC publishes a mutation procedure that refers to **Form A-42** and a **No Outstanding Certificate** from the Assessment Collection Department. The required supporting documents can depend on whether mutation follows a sale, inheritance, apportionment or another event. KMC also provides information on online facilities; confirm the current applicable procedure with the municipal office or portal.
At a minimum, identify the premises number, assessee number, registered transfer details and the existing record holder. Keep copies of your deed and identification materials. If property tax arrears exist, resolve the allocation of liability before assuming the application will progress normally.
Other municipal areas in West Bengal
The state Urban Development and Municipal Affairs Department describes an online municipal mutation service. Its published sequence includes registration, logging in, applying with documents, official verification, a demand notice, payment and downloading the signed certificate. **Jurisdiction matters:** do not use the KMC route merely because the postal address says Kolkata.
New Town and other planned-township properties may involve their own competent authority or transfer conditions. Ask the developer, sellers and authority which records must change and whether any additional consent is needed.
Documents to keep organised
- Registered sale deed or other lawful transfer instrument.
- Chain-of-title documents where requested or needed for legal review.
